These Terms of Use (the “Terms”) are a binding agreement between you and Policy Review Center (“Policy Review Center,” “we,” “us,” or “our”), and govern your access to and use of the website at policyreviewcenter.com (the “Site”) and our related services (collectively, the “Services”). Please read these Terms carefully. By accessing or using the Site, submitting information through it, or otherwise using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site or the Services.

1. Changes to these Terms

We may modify these Terms at any time. When we make changes, we will revise the “Last updated” date above, and the updated Terms become effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site and the Services.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Site and the Services. By using the Site, you represent and warrant that you meet these requirements and that the information you provide is true, accurate, current, and complete. The Site is intended for users located in the United States.

3. What the Services are, and are not

Policy Review Center is a free insurance comparison and referral service. We are not an insurance agency, insurer, or licensed producer. Through the Site we provide a free service that connects you with independent, licensed insurance agents and insurers who can compare options and help you apply for coverage. We do not issue policies, we do not make underwriting or coverage decisions, we do not charge consumers a fee to use the Site, and we are not affiliated with, endorsed by, or sponsored by any single insurer or any government agency (including Medicare, the Centers for Medicare and Medicaid Services, the Social Security Administration, the Department of Veterans Affairs, or any state program). We do not guarantee that you will qualify for coverage, receive any particular rate or product, or be contacted by an agent. Any quotes or figures shown are illustrative and not an offer of insurance. Coverage, rates, products, and availability vary by carrier, by state, and by underwriting, and are not binding until an application is reviewed and approved by the issuing insurer.

4. No professional advice

The content on the Site is provided for general informational and educational purposes only and is not insurance, financial, tax, or legal advice. You should not rely on the Site as a substitute for advice from a licensed professional who is familiar with your specific situation. Decisions about insurance coverage are completed through licensed insurance professionals.

5. Consent to be contacted (calls, texts, and email)

If you request a quote, submit the contact form, or otherwise provide your contact information and consent, you authorize Policy Review Center and the licensed agents and insurers we work with to contact you at the telephone number, email address, and mailing address you provide, including by automated telephone dialing systems, artificial or prerecorded voice messages, text messages, and email, for purposes including responding to your request and marketing, even if your number is listed on a federal or state Do Not Call list. You understand that consent is not a condition of any purchase. Message and data rates may apply, message frequency varies, and you may reply STOP to opt out of text messages or HELP for help. You may revoke consent at any time as described in our DNC Policy and SMS Terms. You also consent to the monitoring and recording of telephone calls with our representatives for quality assurance and training, where permitted by law.

6. Acceptable use

You agree not to, and not to permit any third party to:

  • Use the Site for any unlawful, fraudulent, or unauthorized purpose, or in violation of these Terms.
  • Provide false, inaccurate, or misleading information, or impersonate any person or entity.
  • Submit another person’s information without their authorization.
  • Use any robot, spider, scraper, or other automated means to access, copy, or harvest information from the Site.
  • Interfere with or disrupt the Site, its servers, or networks, or attempt to gain unauthorized access to any system.
  • Introduce viruses, malware, or other harmful code, or engage in any activity that imposes an unreasonable load on our infrastructure.
  • Reverse engineer, decompile, or attempt to extract the source code of the Site, except as permitted by law.
  • Infringe the intellectual property or other rights of Policy Review Center or any third party.

We may investigate and take appropriate action, including suspending or terminating access, for any violation of these Terms.

7. Intellectual property

The Site and its content, including text, graphics, logos, images, design, and software, are owned by or licensed to us and are protected by United States and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your own personal, non-commercial use, subject to these Terms. You may not copy, reproduce, modify, distribute, publicly display, create derivative works from, or otherwise exploit any part of the Site for commercial purposes without our prior written permission.

8. Trademarks and third-party names

“Policy Review Center” and our logos are marks of Policy Review Center. Third-party names, trademarks, and service marks that appear on the Site are the property of their respective owners and are used only to identify the carriers and products we are licensed to compare. Their use does not imply any affiliation with, endorsement by, or sponsorship by those third parties.

9. Third-party links and services

The Site may contain links to third-party websites and services that we do not own or control, including those of insurers, agents, and advertising partners. We provide these links for convenience and are not responsible for the content, products, services, or privacy practices of any third party. Your dealings with third parties are solely between you and the third party.

10. Disclaimers

THE SITE AND THE SERVICES, AND ALL CONTENT, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR ITS SERVERS ARE FREE OF HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY CONTENT.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL POLICY REVIEW CENTER OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to defend, indemnify, and hold harmless Policy Review Center and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site or the Services, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Dispute resolution; binding arbitration; class-action waiver

PLEASE READ THIS SECTION CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS. Except where prohibited by law, you and we agree that any dispute, claim, or controversy arising out of or relating to the Site, the Services, or these Terms will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will be administered by a recognized arbitration provider under its applicable rules, and judgment on the award may be entered in any court of competent jurisdiction. YOU AND WE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Before initiating arbitration, the parties agree to attempt in good faith to resolve the dispute informally by written notice and a period of at least 30 days. You may opt out of this arbitration agreement by sending written notice to us at the address below within 30 days of first accepting these Terms. This arbitration agreement is governed by the Federal Arbitration Act.

14. Governing law and venue

These Terms and any dispute arising out of them are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Subject to the arbitration provision above, you agree that any action not subject to arbitration will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

15. Time limitation on claims

To the extent permitted by law, any claim arising out of or relating to the Site, the Services, or these Terms must be filed within one year after the claim arose, or it is permanently barred.

16. Electronic communications and consent to e-records

By using the Site, you consent to receive communications from us electronically, including by email or by notices posted on the Site, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing.

17. Termination

We may suspend or terminate your access to the Site at any time, with or without cause or notice. The provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

18. General provisions

These Terms, together with the Privacy Policy and any other policies referenced here, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our prior written consent, and any attempted assignment is void; we may assign these Terms freely. We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control.

19. California users
