This Consumer Health Data Privacy Notice (this “Notice”) supplements our Privacy Policy and describes how Policy Review Center (“we,” “us,” or “our”), collects, uses, and shares the category of personal data defined as “consumer health data” under the Washington My Health My Data Act (“MHMDA”). This Notice applies to you if you are a Washington resident or if your consumer health data was collected in Washington. Residents of Nevada and Connecticut may have similar rights regarding consumer health data under their respective state laws.
1. What consumer health data is
“Consumer health data” is defined broadly under the MHMDA to mean personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status. Because we ask only for the limited information needed to provide a quote and connect you with a licensed agent, the consumer health data we may collect is limited.
2. Categories of consumer health data we collect
The consumer health data we may collect can include:
- Information indicating that you are seeking insurance related to health, final expenses, or end-of-life needs.
- Limited self-reported information you choose to provide, such as your age, gender, or whether you use tobacco, when offered to obtain an accurate quote.
- Inferences derived from the above or from your use of the Site that could indicate an interest in health-related insurance products.
3. Sources of consumer health data
We collect this data directly from you when you complete a form, call us, or otherwise communicate with us, and, in limited cases, automatically through the Site or from service providers acting on our behalf.
4. How we use consumer health data
- To provide the Services, respond to your request, and connect you with a licensed agent or insurer.
- To communicate with you about your inquiry and, where you have consented, about related products.
- To secure our systems, prevent fraud, and protect our legal rights.
- To comply with our legal and regulatory obligations.
5. How we share consumer health data, and with whom
We may share consumer health data with the following categories of recipients:
- You, at your request.
- Insurers and licensed agents who provide coverage options based on the information you give us.
- Service providers and processors that help us operate our business, such as hosting, analytics, and call handling, under contracts that limit their use of the data.
- Legal and regulatory recipients, such as law enforcement or regulators, when required by law or to protect our legal interests.
We do not sell consumer health data, and we do not share it with third parties or affiliates for their own marketing purposes. 6. Consent
We collect and use your consumer health data only after you provide it to us in connection with your request, and only for the purposes described in this Notice. We obtain your separate consent before collecting consumer health data for purposes beyond those necessary to provide the Services, and we obtain separate consent before sharing consumer health data where required. We will not sell consumer health data without first obtaining valid written authorization that meets the requirements of the MHMDA.
7. Your rights
The MHMDA provides Washington consumers the right to:
- Confirm whether we are collecting, sharing, or selling your consumer health data, and access that data.
- Obtain a list of the third parties and affiliates with whom we have shared or to whom we have sold your consumer health data.
- Withdraw consent to the collection and sharing of your consumer health data.
- Have your consumer health data deleted, subject to certain exceptions.
8. How to exercise your rights
To exercise any of these rights, reach us through our contact form at policyreviewcenter.com/contact. We will verify your request and respond within the time required by law. You may authorize an agent to submit a request on your behalf, subject to verification.
9. Geofencing
We do not use geofencing to establish a virtual boundary around any in-person health care facility or to identify, track, collect data from, or send notifications to consumers based on their proximity to such a facility.
10. Appeals and complaints
If we decline to act on your request, you may appeal by emailing us with the subject line “MHMDA Appeal.” If your appeal is denied, you may submit a complaint to the Washington State Attorney General at atg.wa.gov/file-complaint.
